Serving Court Documents: Your Guide to Getting It Right

Navigating a separation or family law dispute is already incredibly stressful. The last thing you want to worry about is a technical slip-up that delays your case. One of the most critical—yet frequently misunderstood—steps in the legal process is serving court documents on the other party.

If documents aren’t served correctly, the court may not hear your case, costing you time, money, and peace of mind.

Whether you are dealing with a property settlement or a parenting matter, here is what you need to know about the two main types of service in Australian family law.

  1. Personal Service: In-Person Delivery

When you start a new family law proceeding, the initial documents must generally be served personally (handed directly to the other party). Under the Federal Circuit and Family Court of Australia (Family Law) Rules 2021, personal service is strictly required for:

A Common Mistake to Avoid: You cannot simply mail an initial application to a person’s house or email it to them and consider it “served”. Furthermore, if you are serving a company rather than an individual, strict rules apply under the Corporations Act 2001, requiring service at their official registered office—not just a head office or regular business address.

  1. Ordinary Service: The Next Steps

Once the initial paperwork is done and the other party has filed an address for service, the rules become much easier. Future documents can usually be sent via ordinary service, which includes:

Tip: Never assume a personal email or an address on a letterhead is the correct place for service. We always double-check the formal address the other party has officially provided to the court to ensure your service is legally binding.

What if they live outside Queensland?

If your proceeding is in a Queensland court but the other party lives interstate, strict rules apply under the Service and Execution of Process Act 1992. This requires attaching a specific “Form 1” to the court documents. Forgetting this small detail can completely invalidate the service.
